A 35-year-old Melbourne woman who had sex with a 15-year-old boy
has received a reduced jail sentence because treatment is not available to female sex offenders in custody.
Bianca Aleida Smulders, 35, formerly of Pakenham, wept in the dock as she was sentenced in the Victorian County Court today to at least 12 months in prison.
Smulders had pleaded guilty to four counts of sexual penetration of a child under the age of 16, and was also charged with breaching an intervention order.
The court heard the parents of the victim, who cannot be named, became suspicious of Smulders last July after realising she had bought gifts including cigarettes, CDs, a mobile phone and an iPod for their son.
The pair had sex in the back of Smulders’ car and a caravan at her home on about 18 different occasions between July and October last year, the court heard.
An intervention order was taken out against Smulders on October 18 last year, but the court heard Smulders breached the order by sending letters to the victim.
The pair also had sex in Smulders’ car at the Bunyip State Park, in Melbourne’s outer east, while the intervention order was in place.
They each also sent more than 2,000 mobile phone text messages to one another up until November 3, when Smulders was taken into custody, the court heard.
In sentencing, Judge Geoffrey Chettle said authorities claimed that Smulders be treated no differently to any other sex offender because she was a woman.
He noted the maximum penalty for sexual intercourse with a child under 16 is 10 years in prison.
Judge Chettle sentenced Smulders to 36 months in prison, with a non-parole period of one year.
He said he set a “longer than usual parole period” in order for Smulders’ to seek treatment for her offending while on parole.
He said he did this because courses for sexual offenders were not available to women in prison.
“You will not be able to benefit from a sex offenders course while in custody,” he said.
Judge Chettle said Smulders’ guilty plea and the genuine remorse she had shown for her actions, also entitled her to a substantial reduction in sentence.
Smulders has already served 187 days of her prison sentence.

Nudists push for decent exposure

Queensland looks set to finally catch up with the rest of Australia and get its first official nude beach.
All states and territories except Queensland have had designated clothing-optional beaches since South Australia declared the first, Maslin Beach near Adelaide, in 1975.
The Sunshine Coast has an unofficial nude beach in a national park area at Alexandria Bay, but enthusiasts have long lobbied for a legal beach.
Queensland Premier Anna Bligh and newly-elected Sunshine Coast Mayor Bob Abbot have announced they will not oppose a submission from the Free Beaches Association, calling for one of three proposed beaches to be made clothing-optional.
Association secretary Anita Grigg said the preferred beach was Mudjimba, in a secluded area north of Maroochydore.
Ms Grigg said nudists had been discriminated against, while other interest groups, like dog owners, were given large tracts of beach to use.
“In all areas that we as nudists have tried to find a little quiet spot where we could sunbake nude and mind our own business … we have been persecuted,” she told AAP.
The beach would attract not only 500 local enthusiasts, but tourists from interstate and overseas, particularly the US and Europe, Ms Grigg said.
The group’s Nude Olympics draws about 600 people annually, but that number could double with a legal beach.
“Tourists from overseas ring up and when we say we don’t have a beach that’s legal they say, ‘we don’t want to be locked up’,” Ms Grigg said.
“We are losing huge amounts of tourism dollars.”
Ms Bligh said she was happy to work with the Sunshine Coast Regional Council.
“If they decide to go ahead with it and they require any state laws to change then I’m happy to work with the council to make that possible,” she said.
“Frankly this is not everybody’s cup of tea but I do think that most people would prefer that this sort of activity is conducted on a private beach away from families and away from people who don’t want to see that sort of thing on their beaches.”
Ms Bligh said she appreciated the council was trying to strike a balance between families’ needs and a niche tourism market, but did not want to see nude beaches cropping up across the Queensland coastline.
“I don’t understand it myself, but I accept that there are some people, not just locally but from around the world, who seek out these sorts of opportunities,” she said.

Outcry over topless shots of a 16-year old model

AN Australian magazine is being investigated after photographing a 16-year-old girl topless in two fashion shoots.
Russh Australia, a lifestyle and fashion magazine, hired Zippora Seven for a provocative 18-page editorial fashion spread alongside 16-year-old male model Levi Clarke.
Shot in March, one of the images depicts the pair sharing a bubble bath nude with Seven topless and Clarke’s eyes closed as if he is passed out.
In the foreground are four bottles of champagne.
The Classifications Act prohibits the depiction of nudity and sexual activity of minors under 18.
A spokesperson for the Australian Classification Board said: “I can advise that the board has contacted the publisher of Russh Australia.”
Seven’s Australian agent, Priscilla Leighton-Clark, said the photo shoot had gone too far.
“It’s wrong that our girl has appeared in a magazine exposing her breasts when she’s so young,” Ms Leighton-Clark said.
Russh editor Natalie Shukur defended the Seven shoot, which was inspired by supermodel Kate Moss and actor Johnny Depp when they dated.
“We believe Russh readers ‘get it’ in this narrative story,” she said.
“These are beautiful images of two young people in character.”
Russh is marketed towards fashion-minded 18 to 35-year-olds with almost equal readership of males and females.
In a brief interview with Seven, the magazine asked, “When and where was your first kiss?”
“My first lick was in the bubble bath with Levi,” she answered.
Seven lives in Auckland, New Zealand, but is in demand in Australia and has been shot locally for Vogue and Oyster magazines.
It was her second shoot with Russh this year. She appeared in the March issue topless while riding a horse.
In NZ, Seven is represented by Red11 agency and her mother, Ursula, is heavily involved in her career.
In Australia, she is represented by Priscilla’s Model Management, an agency that has a long-standing reputation for being extremely protective of its models.
“I can’t be on every shoot,” Ms Leighton-Clark said. “Had I known it was to be a topless shoot, (Seven) would never have done it.”

A WOMAN woke up to a real-life nightmare when she discovered the naked man who slipped into her bed in the middle of the night was a thief, not her husband.
The 36-year-old Malaysian woman was asleep when the thief, noticing that her husband was fast asleep on the couch, quietly stripped off and lay down beside her, the Star newspaper said, quoting a police report filed in the eastern state of Terengganu.
The dozing woman’s suspicions were raised when she spoke to him and his voice sounded strange, the paper said.
“She then went to another room and found her husband fast asleep on the couch. That’s when she screamed, causing the thief to flee by leaping out the window together with the stolen items,”

AM I a sex worker or a scarlet woman? I guess it depends on what side of the moral coin toss you get - I’m not attempting to change someone’s moral perspectives but, rather, dispel the myths that have been perpetuated by some in the media of late.
I am a mother, a student at university and, yes, a sex worker. I never use the word prostitute, as I believe it is an archaic term with negative connotations which I do not believe to be relevant to myself or other workers I know.
I first gravitated towards the sex industry as I wanted to provide a better lifestyle for my children.
Previously I was working full time in an office, picking the children up at 5.30pm from child care and spending almost a third of my wage on their care.
I contemplated this new industry,
as I have always been open with my sexuality and found it intriguing

I believe a common thread, particularly among feminists, is that women are being exploited. I argue that some people find it confronting for a women to admit she is happy to get paid for sex, and that she enjoys it.
Others argue that prostitution is a form of violence against women, but as someone who is involved in this industry, I disagree. I am a strong, intelligent, educated woman and I have choices.
I advertise my time on an over-18 website, and exchange services for money. The type of service provided is discussed beforehand, and if I am not comfortable with a request I will decline to see someone.
I have a discreet up-market unit in the city which I do not reside in, and I do not bring any aspect of my work to my own home.
Not only would I not work from home, but legally you cannot work from a house where children reside.
Safe sex is the only type provided as I have too much respect for myself to put myself at any risk. I get health examinations from a sexual health nurse regularly and have never had a sexually transmitted disease.
Studies, some of which can be accessed on the Prostitution Licensing Authority website, show that sex workers have a lower incidence of STDs than women in the general population as they attend sexual health courses and are proactive in their sexual health.
I have now worked in this industry for three years and have not once been the victim of any form of violence. Oh, and I don’t take drugs.
My clients are not sadists or perverts or deviants.
Surprising as it may be to some,
they are doctors, teachers, lawyers, soldiers, stockbrokers and even journalists, to name but a few of the professions that use my services
.
Are all these people morally bankrupt, and am I?
I cannot see the ill effects of two adults agreeing to spend some time together on what is a mutually beneficial basis.
I pay my taxes. I would stop to help an old woman across the road. I’m a good person. If you don’t agree with it, just don’t use the service I provide, but please don’t judge me.

Parents sold daughter for sex

A COUPLE who sold their daughter into prostitution for eight months using the internet to advertise her services should spend twice as long in jail, a court has heard.
In what was described as the “most horrific case of child prostitution in Australian history’’, the girl’s mother was jailed for 13 years and her father for 10 years.
The Gold Coast couple pleaded guilty to more than 60 offences including maintaining a sexual relationship with a child and prostitution in the District Court at Southport, in January.
But after time served on remand and parole recommendations the mother will be eligible for release on March 10, 2010, and the father last month. He has not applied for parole pending the appeal.
The Attorney General, Kerry Shine, went to the Court of Appeal today seeking to alter the sentences so they carry a serious violent offence classification which would mean both would serve 80 percent of their sentences - the mother 10 years four months and the father eight years.
However, Michael Copley, for Mr Shine, said it was an unusual appeal because the sentencing judge had given the highest sentences for the prostitution offences and not that of maintaining a sexual relationship wth a child.
He said prostitution was not a serious violent offence under Queensland laws but maintaining a sexual relationship with a child was one.
Mr Copley admitted it was a curious maintaining charge because neither parent was accused of carnal knowldge of the girl.
The mother faced that charge because she had posed the child for advertising photographs used on the internet and had also aided in the rape of the girl by another man.
The father had helped pose the child for the photographs and had lived off her earnings.
The court heard the girl was aged 12 and 13 years at the time she had sex with various men during an eight months period in 2004.
The Court of Appeal reserved its judgment.

Cop slits lover’s throat, rams her with car
KUALA TERENGGANU, MALAYSIA:
A jilted lover attempted to murder his girlfriend by slitting her throat before trying to run her down with his car.
The man, a cop who had been suspended due to disciplinary problems, is believed to have attacked the victim, with a parang, while she slept in her house at Kampung Wakaf Tembesu at about 7.30am yesterday.
It is learnt the 23-year old victim had earlier told her boyfriend of a few years that she was seeing someone else.
The victim, who was bleeding profusely, managed to escape before the suspect could injure her further.
Her housemate, who heard the commotion, ran to her aid and took her to the main road in a desperate attempt to save her life.
The 27-year-old suspect who saw the two standing at the roadside, tried to ram into them but instead his car skidded.
He fractured his right leg in the accident.
Passers-by rushed the victim to hospital and she is in stable condition at the Sultanah Nur Zahirah Hospital intensive care unit.
OCPD Asst Comm Zami Shamsuddin said the suspect, who is based in Rantau Panjang, Kelantan, was arrested in Tepoh yesterday and treated at the same hospital as the victim.

Call to carry condoms

In view of the rising number of women contracting HIV,
every woman should carry a condom with her for her own protection
, said Deputy Health Minister Datuk Dr Abdul Latiff Ahmad.
“This is not to debase them but to protect them.
Women are the first ones to get exploited by their partners
. But this is just a suggestion, it’s up to them,” he told the press after delivering his speech at the International AIDS Memorial Day here yesterday.

It was the first time that the International AIDS Memorial Day was celebrated openly in Malaysia. The celebration was attended by about 1,000 people.
According to Health Ministry figures,
745 women contracted HIV last year. It is a slight dip compared to 2006 (875)
, but the general trend is that the numbers are on the rise.
As for AIDS cases, 193 women were diagnosed with the syndrome, and 131 women died from it, while in 2006, 222 women were diagnosed positive and 80 died from it
.
Malaysian AIDS Council president Prof Dr Adeeba Kamarulzaman said apart from sex workers,
many women who contracted HIV were housewives, infected unknowingly by their husbands who could be drug addicts
.
“It’s not that people don’t know that condoms can protect them. But there are some men who do not care to take the precaution even though they know they have HIV.”
The figures also showed that last year alone, three people died of AIDS each day in Malaysia.
By ethnicity breakdown, Malays recorded the highest number of HIV sufferers (58,267 in total), followed by Chinese (11,886), Indians (6,532) and foreigners (2,722).
“One reason why Malays are the highest (recorded) is because of our large population. But it’s also because of the high number of injecting drug users.
“I urge the Malay leaders and the Malay non-governmental organisations to come forward to champion this cause,” Dr Abdul Latiff said.
Power tool sex toy lands woman in hospital
SOME sexual experimentation landed an American woman in a hospital with injuries tough to imagine and even more difficult to forget.
The Maryland woman was flown to hospital on Monday after she was injured in the incident involving a
sex toy attached to a sabre saw blade
, according to NBCWashington.com.
The man who called 911 about the incident admitted
attaching the sex toy to the saw and then using the high-powered, homemade device
on his partner, the St Mary’s County Sheriff’s Office said.
NBCWashington.com reported the saw cut through the plastic toy and wounded the woman.
The injuries were severe enough for her to be flown to hospital but she was released on Tuesday.
